Advisory Notes Under section 109(1)(e) of the Radiocommunications Act 1992, it is a condition of this licence that the licensee, and any person authorised by the licensee to operate the radiocommunications transmitter under this licence, must comply with the technical planning guidelines developed by the Australian Communications and Media Authority under section 33 of the Broadcasting Services Act 1992.

Sections 1, 2, 3 and 5 of Part 1 of the Radiocommunications Licence Conditions (Apparatus Licence) Determination 2003, as in force from time to time, do not apply to broadcasting licences (broadcast service stations) that authorise the operation of transmitters to provide a commercial broadcasting service or a community broadcasting service.

Conditions applicable to the operation of Broadcast Service station(s) authorised under this licence can be found in the Radiocommunications Licence Conditions (Apparatus Licence) Determination and the Radiocommunications Licence Conditions (Broadcasting Licence) Determination. Copies of these determinations are available from the ACMA and from the ACMA home page (www.acma.gov.au).

This service may not be meeting the Technical Specification in all respects. Regulatory forbearance has been exercised pending consideration of an application to vary the Licence Area Plan.

Part 3 of the Radiocommunications Licence Conditions (Broadcasting Licence) Determination does not apply to broadcasting licences (broadcast service) that authorise the operation of transmitters to provide a commercial broadcasting service or a community broadcasting service.
Special Conditions The licensee is subject to Parts 1 and 2 of the Radiocommunications Licence Conditions (Broadcasting Licence) Determination.

The licensee must ensure that no harmful interference shall be caused to the operation of any radiocommunication station or service. If the operation of the transmitter is causing interference to other services, the licensee is required, at the licensee's own expense, to adjust, or fit devices to, receivers in order to eliminate or minimise that interference.

The licensee, or any authorised person, is required to place advertisements in newspapers circulating within the licence area of the licence at least seven days before the commencement of transmissions. The advertisement should state that members of the public should contact the licensee, or authorised person, if the broadcast causes interference to other radiocommunications. The advertisement must detail the date and the time of the commencement of transmissions, the frequency being used and the appropriate person's contact details, including the address and telephone number of the person responsible for the transmissions.

The licensee is subject to section 4 of part 1, and parts 2, 3 and 4 of the Radiocommunications Licence Conditions (Apparatus Licence) Determination, as in force from time to time. For this special condition, the reference to paragraph 107(1)(f) of the Act in part 2 of the Determination should be read as a reference to paragraph 109(1)(f) of the Act.
