Part 3 of the Radiocommunications Licence Conditions (Broadcasting Licence) Determination does not apply to broadcasting licences (broadcast service) that authorise the operation of transmitters to provide a commercial broadcasting service or a community broadcasting service. Conditions applicable to the operation of Broadcast Service stations authorised under this licence can be found in the Radiocommunications Licence Conditions (Temporary Community Broadcasting Licence) Determination 2003, as in force from time to time. Copies of this determination are available from the ACMA and from the ACMA home page (www.acma.gov.au). Under paragraph 108a(1)(d) of the Radiocommunications Act 1992, it is a condition of this licence that the licensee, and any person authorised by the licensee to operate the radiocommunications transmitter under this licence, must comply with the technical planning guidelines developed by the Australian Communications and Media Authority under section 33 of the Broadcasting Services Act 1992. This licence continues in force while the broadcasting services licence remains in force. This licence does not have effect while the broadcasting licence is suspended. |
Special Conditions |
The licensee must ensure that no harmful interference shall be caused to the operation of any radiocommunication station or service. If the operation of the transmitter is causing interference to other services, the licensee is required, at the licensee's own expense, to adjust, or fit devices to, receivers in order to eliminate or minimise that interference.
The licensee is subject to Parts 1 and 2 of the Radiocommunications Licence Conditions (Broadcasting Licence) Determination. The licensee, or any authorised person, is required to place advertisements in newspapers circulating within the licence area of the licence at least seven days before the commencement of transmissions. The advertisement should state that members of the public should contact the licensee, or authorised person, if the broadcast causes interference to other radiocommunications. The advertisement must detail the date and the time of the commencement of transmissions, the frequency being used and the appropriate person's contact details, including the address and telephone number of the person responsible for the transmissions. |
